Misconduct Policy

1. Purpose

Kids Discovery International Academy at Milton (the “School”) establishes the procedures for reporting misconduct by instructional personnel, school administrators, and other employees whose conduct may affect the health, safety, or welfare of a student. This policy supplements, and is incorporated by reference into, Policy 5.01.

2. Reporting Employee Misconduct

All employees must promptly report suspected or alleged misconduct by another employee that affects the health, safety, or welfare of a student. Reports concerning instructional personnel or educational support employees are made to the Chief Administrative Officer at (850) 865-6841 or kmurdy@kidsdiscovery.com. If the allegation involves a school administrator, including the Chief Administrative Officer, the report is made to the Owner / COO of ELA Devine Schools Holdings, LLC at (703) 206-6225 or mszalay@pansophiclearning.com. Failure to report as required by Florida law may result in disciplinary action, up to and including termination.

3. Investigation of Allegations

The Chief Administrative Officer, or a designated investigator, shall promptly investigate any allegation of employee misconduct affecting the health, safety, or welfare of a student, regardless of whether the employee resigns or is terminated before the investigation is completed. The School cooperates fully with law enforcement, the Florida Department of Education, the Department of Children and Families, and any other agency with jurisdiction.

4. Reporting to the Florida Department of Education

When required by Florida law, including sections 1012.795 and 1012.796, Florida Statutes, the School submits a legally sufficient complaint to the Florida Department of Education regarding misconduct by a certificated instructional employee or school administrator, within the time required by law.

5. Reporting Resignations and Terminations

If misconduct by a certificated employee or administrator affects the health, safety, or welfare of a student and warrants termination, the School reports it to the Florida Department of Education in the prescribed manner, regardless of whether the employee resigns in lieu of termination.

6. Accuracy of Reports

No employee or school official shall knowingly submit or authorize a report to any governmental agency that is false, misleading, or materially inaccurate.

7. Disclosure of Employee Misconduct; No Concealment

The School shall not enter into any agreement that conceals misconduct affecting the health, safety, or welfare of a student. When permitted or required by law, the School discloses substantiated misconduct to prospective educational employers and will not provide references that intentionally omit misconduct required to be disclosed under Florida law.

8. Liability Protections

Reporting immunity (s. 39.203, F.S.) and employment disclosure immunity (s. 768.095, F.S.) apply as described in Policy 5.01.

9. Posting Requirements

Per section 1006.061(2), Florida Statutes, the School posts at its facility and on its website the procedures for reporting alleged misconduct affecting a student’s health, safety, or welfare; the role to whom reports are made; and the penalties for failing to report. An employee who knowingly and willfully fails to report suspected child abuse may face criminal penalties under section 39.205, Florida Statutes, and an employee who fails to report misconduct is subject to disciplinary action up to and including termination.

This policy is interpreted consistent with sections 39.203, 768.095, 1006.061, 1012.795, and 1012.796, Florida Statutes, as amended.
